Second & Third DUI Defense in Gainesville

Evidence-Focused Defense for Repeat DUI Charges

A second or third DUI charge requires careful attention to the current arrest, the prosecution’s evidence, and the dates and validity of any earlier convictions. Law Office of Edwards, Jones & Doll represents people facing multiple DUI allegations in Gainesville, Florida, with a defense strategy built around those details.

Our firm reports more than 60 years of combined criminal defense experience and more than 1,000 cases handled. We’re Board Certified in Criminal Trial Law and prepare every case as if it may go to trial. Because Florida law treats second and third convictions differently, we explain the potential penalties and licensing consequences before developing the defense.

Call (352) 329-3632 promptly to discuss a second DUI, third DUI, or multiple DUI charge with our team.

Penalties for a Second DUI in Florida

A second DUI conviction can bring increased fines, incarceration, vehicle immobilization, an ignition interlock device, and a longer license revocation. The date of the earlier offense is especially important because Florida imposes additional mandatory consequences when the second conviction occurs within five years.

Potential consequences of a second DUI conviction include:

  • Fines: From $1,000 to $2,000.
  • Incarceration: Up to nine months, with at least 10 days required when the conviction occurs within five years of an earlier DUI conviction.
  • License revocation: A minimum five-year driver-license revocation when the conviction falls within the five-year lookback period.
  • Ignition interlock device: Installation for at least one year.
  • Vehicle immobilization: Impoundment or immobilization for 10 or 30 days, depending on the circumstances.

An ignition interlock device tests a driver’s breath before allowing a vehicle to start. We examine which earlier offense the prosecution is relying on, when it occurred, and whether the records support the alleged multiple-offense status.

Third DUI Charges Within & Outside 10 Years

A third DUI in Florida may be prosecuted as a felony or misdemeanor based on the timing of earlier offenses. A third conviction within 10 years of an earlier DUI conviction is a third-degree felony. It requires at least 30 days of imprisonment and can carry up to five years of imprisonment and a fine of up to $5,000.

A conviction within that period also results in a minimum 10-year driver-license revocation and a 90-day vehicle impoundment or immobilization requirement. Hardship reinstatement, which may permit limited driving under approved conditions, can become available after two years, but eligibility and approval aren’t guaranteed.

A third DUI outside the 10-year period is a first-degree misdemeanor rather than a third-degree felony. It’s punishable by up to 12 months in jail, carries a fine from $2,000 to $5,000, and requires an interlock device for two years after the person becomes eligible for a license. When defending third DUI allegations in Gainesville, we check the earlier DUI records and the dates that determine which framework applies.

The 10-Day Administrative License Deadline

The criminal prosecution and administrative license suspension are separate proceedings that can move forward at the same time. A driver who wants to challenge an administrative DUI suspension must request a formal review hearing with the Florida Department of Highway Safety and Motor Vehicles within 10 days of arrest. Missing that deadline waives the right to challenge the suspension through a formal review hearing.

Florida’s implied-consent law requires breath, urine, or blood testing after a lawful DUI arrest. Refusing a requested test results in a license suspension, and a second refusal can be charged separately as a first-degree misdemeanor. Those administrative consequences are distinct from whether the prosecution can prove the DUI charge in criminal court.

After an arrest, preserve all citations, release documents, testing paperwork, and property receipts. Don’t discuss the incident with others or explain your side to police or prosecutors without counsel. Write down what you remember about the stop, roadside exercises, testing, statements, and arrest while the details remain fresh. If the charge may qualify as a felony, contact a felony DUI attorney promptly.

How We Examine Multiple DUI Evidence in Gainesville

Our investigation begins with the evidence behind the current charge and the records used to classify it as a subsequent offense. We gather officer reports, video, field sobriety records, breath or blood test records, and relevant DUI history. Because an earlier record can affect the charge level and mandatory penalties, we examine it as closely as the evidence from the current arrest.

Our evidence review addresses:

  • The traffic stop: The stated reason for the stop and the observations recorded by the officer.
  • Field sobriety exercises: How the exercises were explained, administered, observed, and documented.
  • Chemical testing: The procedures and records associated with breath or blood testing.
  • Prior convictions: The identity, timing, and court records of convictions alleged by the prosecution.

Misdemeanor DUI cases are handled in county court, while felony DUI cases proceed in circuit court. Felony cases arising from Gainesville and Alachua County fall within Florida’s Eighth Judicial Circuit. Arraignments and felony hearings commonly occur at the Judge Stephan P. Mickle, Sr. Criminal Courthouse, although the location and course of a case depend on its filing and procedural posture.

We prepare each case with trial in mind rather than assuming the allegations or testing records are conclusive. This preparation provides a structured basis for evaluating the evidence, addressing legal issues, and representing the client in negotiations or court.

"It is my opinion that he is clearly one of the best lawyers in the city of Gainesville."
I had the pleasure of having Mr. Edwards represent me in 2006. While I was charged with a crime, Mr. Edwards insisted sternly that he was very confident he could successfully defend the charges against me. This man exudes confidence. It is my opinion that he is clearly one of the best lawyers in the city of Gainesville. You can't go wrong with Mr. Edwards!!!

"Mr. Edwards believed in us and took a chance, we will forever be in his debt."
We are from Lake City, Florida. As parents, we sought the help of Mr. Edwards on my daughter's behalf. As a young lady, she had acquired multiple felonies with the prospect of 10-15 years in prison facing her. Mr. Edwards heard our case, took it on with confidence, and got her sentence reduced to 10 years probation, and restitution. That was 8 years ago, and my daughter is married, has a son, and is doing great. She hasn't even had a traffic violation. Because Mr. Edwards believed in us and took a chance, we will forever be in his debt. He is a great lawyer, with a very big heart.
